Can both parents (divorced) be joint guardians of a special needs adult child?

by Emmanuel Thompson
(Etobiocke, Ontario, Canada)

We have been divorced since 2013 and our 21 year old son with down syndrome lives with my ex of which I accepted. Recently she filed for sole guardianship for our son and I raised concern about it. My question is can both of us be legal guardians at the same time? In questioning her motive, she explained that it is because of her estate that's why.

I am not interested in her estate or financial decision of my son...my main interest is to make sure the educational programs he will be participating in will be something of value that will benefit him and worth the money spent to be spent, going forward.

I am at the moment paying $300.00CDN to my ex for my son. Is it possible to divide the money into 2 and put the other in Trust for him?

Please advise
