Child Support and ODSP

My 22 year old son receives ODSP. His deadbeat dad has never made regular payments and is close to 10,000.00 in arrears.

We haven't received anythiing since he is on ODSP. I submitted the separation agreement to FRO that says he still has to pay. My EX, recently got a lawyer and is fighting to change those arrears simce he turned 18 becasue on? he receives ODSP.

Would I have to pay all that to ODSP if I won?
Support is owed to me and not my son, so would it be considered his income?

Currently, child support payments are deducted dollar for dollar from your son's ODSP benefits. There is a court case from 2006 which brings this practice into question but no action has been taken by ODSP. If you are interested, you can contact me directly at graemetreeby@sympatico.ca and I will provide you with the court case involved. We are hoping that this will change in the near future.
